any personal injury people around? Georgimama? Credit Card and Personal Injury Query

So, long story, but DP bought car with credit card. There was an appalling smell of diesel, so he returned it, and they found a puddle of diesel in the back on the car . Seemed that they sorted it out as it wasn't a leak.

Anyway, the smell still lingered, so he took it back and they cleaned it, but still overwhelming smell of diesel.

Meanwhile he was taken to A & E last night (from work ) and diagnosed with diesel poisoning.

He took car back for a refund and it's now being dealt with my the credit card people, but in the meantime, will personal injury claim include any personal injury? He went back to GP this afternoon, and it's on notes.

If you hubby was not kept in and is not off work sick then any payout would be minimal as you technically have no losses to compensate for. You would also have to prove they were negligent.

Your credit card would need to have legal cover to help with a claim, the standard chargeback wont include anything else other than a refund.

There are not enough details in your post though.

Thanks! Re: chargeback. If successful, who owns the car? or rather what happens to the car? Do the credit card people take it away?
