Basically a man hit back of my car in Aug 08 (I was stationary) had both the dd's in the car (dd1 was 3 and dd2 was 19 months) dd2 was fine but dd1 had a nasty bruise from seat belt on her chest and I suffered whiplash.

Saw many medical people as per other sides insurance requests and there solictor advised them to settle last summer on amount my solicitor suggested (they made an offer of £1400 but my solicitor declined but if judge awards less than that amount then we I do not receive anything)

My solicitor managed to get a cancelled court date for tomorrow around 10 days ago, he contaced d other solicitors who again said they were happy to settle but the mans insurance company wont agree, it took them months to cough up fro my dd's replacement car seat and again ages to admit liability even though he hit the back of my car (only on the threat of retrieving CCTV did they admit liability!)

The other side have had 3 different independent doctors look at my medical records/report from accident and they have alla greed that injuries were consistent with whiplash and my soliciotr seems very confident that'll we will win but I am getting very nervous.

Apparently they have agreed to settle on dd1 claim but we need another court case for that as a judge will decide what dd1 will be awarded.

not happende to me, but good luck ! surely someone driving into the back of you is liable without question? I suppose the only thing is how much compensation you will get? surely there is a set scale and it will also be to do with how much time you had off work/loss of earnings etc>

Lets hope so, it happened on a Saturday I went to Drs on Monday as felt okay on Sunday but really ached Monday and went to work monday afternoon (work in a bank but sat in back office and did light admin as only work monday and friday had tues/weds/thurs at home)

Honestly his insurance company are a nightmare they hassled me from the day after accident that they would collect my car and fix it etc etc in the end I refused all calls and sent them a recorded letter reminiding them they needed to deal with my insurance company directly etc etc.

Just hope I get a nice judge (thankfully because the court date was set on a work day my Mum can look after DD2 and take/collect DD1 on school run as normal otherwise DD2 would have had to come with me!)
