How should I respond after my ex breached the child arrangements order?

4yrs ago I fled DV from my ex partner. We relocated to a new town etc. Child arrangements order was put in place where my ex was allowed indirect contact via letters once a month sent to my parents home. He wasnt allowed to know our new location, childs school etc. At the beginning of August my child said he was going to a sleepover, I knew the other child & their family via school so allowed it. The next day when I tried to contact my child they didn't answer. I called the other parent asking if I could speak to my child & they told me their dad had picked them up. I explained he wasn't allowed contact with his dad, explained the court order etc she said "not my problem" & hung up. I immediately called the police, an officer came to the home stated another officer was going to my exs home, read through the court order etc said my ex wouldnt be arrested. They never told me if my child was found at my exs address they left saying they had other calls to deal with. My child returned home 20mins later stating their dad had dropped them off at the end of the road but watched them walk up to the house. Panic set in because they now knew our address. I explained to my child how worried I was & had to call the police. My child threw into a rage, smashed their room up with a hammer, then ran to the kitchen, picked up a knife & threatened to stab me. Again I called the police. 2 officers arrived & calmed the situation down, during this incident my child admitted they had seen their dad on 4 separate occasions before the overnight stay, had communicated via social media. I called my solicitor the next day explained the situation & she said the order had been broken but to try & speak to my ex about varying the order. I explained i didnt feel safe now my ex knew my location. Told her about what happened when my child came home, she explained the breach of court order process. We sorted out things to get legal aid in place if my ex was to take it back to court. My ex then wrote his usual letter to my child & the contents acted like he had not seen my child at all. Asked how their summer was, how school was etc but he knew all this already from the visits. I contacted our support worker & explained everything to them she also suggested sorting something out with my ex without court involvement. I told her the trust was broken but he hadnt told anyone about these visits when he should have informed someone, just kept it secret. My child disclosed their dads new wife left him last year becasue he was violent towards her & their daughter but she returned if he promised not to do it again. Im at a loss of what to do? Do I file to the courts myself & explain my reservations about the whole situation & further contact or let him take me back to court? I assumed if he wanted to see our child that badly he would have contacted the courts himself by now (its been over a month since he last saw them) but heard nothing. I have shut down all social media via my child. Put trackers on their phone. Isolated myself but everyone is telling me to speak to my ex because its whats best for our child. Im at a loss of what to do

I have spoken to my solicitor & she said to talk to my ex about varying the order if my child wants contact with them

I would ask for supervised contact considering the history.

Call your child's school today and speak to the safeguarding lead.

I think there's a few things that need to happen - child services need to be made aware of what your ex is doing, the school needs to be made aware there has been a breach of the court order and that your child threatened you and your child needs someone trusted and safe to speak to about this. It could be a member of staff at school or they may be able to arrange some independent counselling.

Hope much does your child know about the violence towards you?

Apply to the court for a non-molestation order. It’s free to apply/get one and it will make it a criminal offence for your ex to contact you/your child outside of the CAO terms. If he approaches your son again he will be arrested.

How has your 9 year old seen his dad 4 times without you knowing? Does your ex know the people with whom your son had a sleepover? Is there, or was there a non mol in place?

Your solicitor's response seems strange OP. Is there more to this situation than you're telling us? I appreciate you might not be able to say what.

I would talk to the safeguarding lead at your child's school and seek advice from your local domestic abuse organisation.

How has your 9 year old has been on social media and met with their Dad without you knowing?

You are a high risk victim of domestic abuse, this is a serious safeguarding issue.

Speak to your son’s school. Their behaviour shows they have been seriously impacted by the domestic abuse, and need therapeutic support. I would not be surprised if - and really hope that - a report is made to Social Care by the Police or School.

Engage fully with all support offered to you and your child. Engage with your local domestic abuse service.

Ultimately the cat is out of the bag so to speak. If you block your child from having contact now, he will likely try and run away. You now need a proactive approach to managing child contact and risk.

Yes to speaking to the school. You need to get a prohibitive steps order and ask for a penal notice attached to it, that way the police have to get involved, if it happens again.

I have done all of the above. Everyone is telling me to speak to my ex to vary the order if my child wants to see them.
He used his friends computer to access social media. I have put a block on it in my house, accept for my own but my phone is fingerprint & password protected, I dont have a laptop, tablet or PC

What an awful situation. Is your solicitor experienced re. DV? The reason that I'm asking is they should not be asking you to communicate with your abusive ex. This is retraumatising for you.
Do you have support from a domestic abuse charity? They can advise and support you, and possibly suggest a solicitor that specializes in domestic abuse.
It sounds as if your child has been severely impacted, by having a father who is a perpetrator of domestic abuse. The safeguarding lead at school, should be able to support your child.

But he knows now, so their reasoning for refusing it before is no longer valid.

When I read the op I thought the child is 15+ and they are not 10 yet... Phone and social media accounts. Sleepover that is not properly arranged by both kids parents, at 9 years old... I don't want to sound harsh but you probably wasn't that careful with your own safety either!
