Advice desperately needed please.
My ex husband was meant to transfer the equity to myself, removing himself from the title of deeds. This should have been done 6 years ago but he wouldn't despite the court order.
After 9 long weeks of asking he has said he will do it.
He needs to remove himself from the deeds but his name stays on the mortgage as he was the main applicant and I cannot remove him.
The mortgage company has agreed for him to be removed from the title of deeds.
As he was ordered to remove his name I, ignorantly, was under the impression he would have to organise it, pay for a solicitor and i would just need to sign but his solicitor has said I need a solicitor as mine will do the majority of work therefore costing me a significant amount of money that I simply don't have.
I have an income of £10,000 a year. I have tried CAB but they say seek legal advice. I have tried calling various advice lines but am yet to get through and I am getting differing advice from solicitors!
Apparently my solicitor has to :
Prepare the transfer deed
Send the documents to me and ex to sign
Will organise and deal with the amended mortgage
Submit an application to Land Registry
Is this correct? If so I can't fund it. Then what can I do?
Also, even though he has no claims to the house at all, as his name is still on the mortgage when I sell he has to agree estate agents, photos, what the house is sold for etc? This is a real invasion of privacy and as he was very controlling and financially abusive I fear the outcome. He has always said he will only accept the lowest offer!
If his name is off the Title of deeds do I still need him to agree the sale? If so, what can I do to stop this?
I have no money, I am living hand to mouth and am finding this incredibly stressful and I am desperate. I need to remove him from my life to be able to move on but 12 years from the start of the divorce and I am still stuck.
I don't know what to do?
Can I do this without a solicitor?
Can anyone help please?
