Consent order approved in face to face court hearing. I buy ex out for X amount, so i have a mortgage approved, the conveyencing solicitor has now said they will contact ex for his agreement??? He has twice got to the stage of me having a mortgage offer then refused to sign, hence me going to court and spending a fucking fortune that I dont have. I NEED this to go through quickly for financial reasons.

Has he got me over a barrel again? If he doesnt agree I have to go back to court, is this correct?

Yes you’d need to apply to enforce the order and you can also seek an order allowing the judge to sign instead of him. You can apply for a costs order given his unreasonableness (I’m a solicitor and in similar circumstances have successfully obtained costs orders)

It's a pity that Count Orders don't come with built in enforcement

Isn't it? Yet another way to hang on to some control and cause me worry and stress.

Yes, it’s such a joke. Completely unfair that you have to go back to court. Do you have solicitors? I’d suggest a warning letter first to say if he doesn’t comply within X days or weeks, you’ll be enforcing the order and pursuing costs.
