Would council take action in neighbour spraying weedkiller on my land?

Just that really. V V V V longstanding issues with neighbour. I don't want to contact the council's env health if there is a chance they will say no statutory duty to do anything and fob me off.

https://www.hse.gov.uk/pesticides/user-areas/members-of-public.htm

In particular

Users must keep the pesticide to the area they are treating. For example, they must not let pesticide spray drift on to property belonging to other people.

Then

So its reportable to The Local Authority & I suggest The Police as criminal Damage

Update for anyone who might find themself in the same utterly bonkers scenario - local env health not interested.

Get on to your Councillor and the Anti Social Behaviour team or whoever was involved last time.

Do you have legal expenses cover in which case what about an injunction, ideally with power of arrest

MissMoneyFairy · 11/07/2025 08:46

The police, you don't know what was sprayed, it could be harmful to children and animals, get a restraining order.

Have no advice but I am sorry you live next door to horrible neighbours - big hug

Just googling what to do about this exact scenario and my own sodding post on the exact same thing from last year came up.
