I was sued in the Small Claims Court. I attended the hearing, the claimant didn't. His claim was considered fairly and dismissed. I won most of the amount I counterclaimed.
The day we received our Judgment letters he wrote a cheque, which he posted to me second class Signed Delivery the following day.
He wrote the amount where the payee's name should go. My name is not anywhere on the cheque and my bank says it cannot be paid. He is fully literate, has considerable business experience and must understand cheques.
I emailed him last Friday 21st March with a photo of the cheque, politely pointing out the error and asking for a replacement. No response at all.
The court ordered payment by 28th March.
How would you interpret this? What should I do? Should I point out the implications for his credit rating if he doesn't pay quickly and properly?
