How to determine who is owner of property

Hi. I am going through a divorce and my partner has had to perform a PN1 search from the land registry( to check all properties held under their name. The search has found 3 properties held under their name( 2 with another owner who shares a same name as their sibling). I am suspicious that they are jointly owned by my partner. They have had to take a statement of truth which they deny being the owner.

Is there anyway t find out who the owner is and Wether it is my ex partner?

I don’t know anything about the land registry but surely your solicitor would be able to access additional information such as dates of birth, addresses or other identifying information in respect of registered owners?

My solicitor was unsure either! I was very surprised by this. Surely someone previously has been in a similar situation and has had to check this?

You just need to search for the title numbers through.Land Registry and apply for copies of the register. If you have the property address you can do this.

If they are the legal owner they will be named on the register. If they have a beneficial interest there may be a charge or notice with them named.

Sorry some confusion here. The person is stating that these properties are owned by someone else who shares the same name. How would I find out if this is true or not as I believe the land registry records do not share other points such as Dob which would confirm if they are the same person or not.

No but if you order the full title it will show the correspondence address the owner is registered to. So it might say property A owned by J smith (your home address)

I think you can also order copies of deeds to see signatures. But their address for service should give them away.

There will have been evidence of identity shown to a conveyancer at the time of transfer. These details should be in the historical form AP 1 but I'm unsure if you can order this.

Contact the land registry and ask what other info they have. They will have copies of TR1s and maybe other documents.
This may show more information as the TR1 you have to provide an address

So have you asked your ex and they say 'nope, not me'?
How long was the marriage? How would they have been able to hide owning three properties from you?

Interesting question I might suggest

  1. Where are the properties, are they in an area he might have a connection with - or not?
  2. I don't know why you did a PN1 but I suggest that its down to him to get confirmation that its a different person with the same name whose the owner

Given the situation you have I suggest that you should be asking your ex to get the relevant details to confirm he isnt the owner and to draw a negative inference if he refuses

Thanks for your help. My partner has been asked to sign a statement of truth to confirm they are not the owner. They have now done this and I now believe they are not the owner. However, I intend to investigate this further and may order the paperwork from land registry, just to be sure
