Has anyone had a fact finding in the family court

Hi my ex is taking me to court for contact with our son. I reported him to the police for domestic abuse but did not go ahead with pressing charges.

We have our first hearing later this week Cafcass have said they are going to recommend a section 7 and it might go to fact finding. Has anyone had a fact finding? What did it involve. How do you prove abuse in the family court? I just want to keep my boy safe.

A judge will listen to verbal evidence and see any other evidence you have and make a decision regarding whether they believe it happened or not. This is an example of why it's important to support police action in cases of abuse. Good luck with it.

I do have quite a bit of evidence and I have been getting support from women’s aid. It all sounds very scary.

For cases that don't involve credible allegations of coercive and controlling behaviour the court is likely to focus on half a dozen allegations. For c&c allegations the allegations likely to be examined are far more.

There is coercive control. They are not going to do a fact finding just a section 7. So it is as if there was no abuse. I am so devastated.

I'm sorry op. However even if you could prove domestic abuse against you. It doesn't automatically mean they don't get contract with their kids. Convicted abusers the country over have regular visitation . I think the logic is that because they've been abusive to a partner it doesn't automatically follow they will be abusive to their kids.
I'm trying not o point out that it might not have been that you weren't believed .
