Looking for some advice please.
I have a 12 year old DS and his father has been practically non existent in his life. He paid Child Maintenance for the first 8 years of his life, often threatening that he wouldn't, so I got CMS involved. About 4 years ago DS father took redundancy in a job he'd been in at least 25 years and it was approx 120k. Due to the 'garden leave' policy he couldn't work for minimum of 6 months, so no child maintenance was paid. Then he worked now and again (I'm guessing consultancy work)
2 years ago I was told by CMS he was claiming benefits and I received £30 a month until January this year. I was told he had nil income! I questioned it with them but they said he'd sent in proof. How can you survive on nil income?
Today I received a text from CMS stating maintenance will be paid again from 30 Aug. I called up as the letter stated that his income had been 470ish per week since the middle of JANUARY!! I queried why he's been working for over 6 months without paying a penny and was told that he had a legal obligation to inform them. Yet this 'legal obligation' seems pointless.
Nothing will happen to him. Can I take this further? CMS haven't discovered the income, someone has reported it (she asked if it was me, I have nothing to do with him, no knowledge of his life whatsoever) She said they do not have the capacity to check every case where the parent states nil income. I was under the impression that the DWP shared info with HMRC and vice versa, so that it would flag up when someone started working.
I'm actually not too sure what advice I'm asking really (I may just have needed to vent) I'm so shocked that he's knowingly worked, claimed he isn't to CMS, and got away with it for all these months. With no repercussions.
