Mat leave discrimination?

Hi,

Would appreciate some advice please.

I’m on mat leave and recently found out that my employer had hired someone external into a job I would have applied for had I been at work/known about it - it would be a promotion for me.

I didn’t see the job advertised and they didn’t tell me it was open. Before I went on mat leave I made it clear to my manager I’d be open to cutting my leave short if any opportunities came up.

I read that the onus is on the employer to inform employees of promotion opps when they’re on maternity leave.

Anyone wiser and more qualified than me able to tell me if they’ve done something wrong, or if I’m just overreacting and it’s tough that I missed the chance?

So the Pregnancy/ Maternity protected characteristic of the Equality Act 2010 wouldn't apply?

I would have thought that reasonable adjustment would have meant that OP should have been informed of the vacancy as she is on Maternity leave.

If they advertised internally via usual channels- intranet / email etc and you just didn’t see it then they have done nothing wrong as you would have had the opportunity to see the advertised job - even if on Mat Leave as you still should have access to those channels. They don’t have to specifically contact you while on leave to say this job might be suited to you. BUT if they didn’t share internally and you had no way of knowing about it because you were not in the office and that is how they communicate internal roles, then that could be considered as discrimination, as by being on ML you would not be there to get the comms and it should have been shared to you in other ways

Yeah ok, so you could habe looked if you were interested that changes it op, a lot. The fact you didn’t look is on you I’m afraid.
