Family court domestic violence

Looking for some advice.

Long story short, when my son was 2 months old when his dad assaulted me while I was holding him. Resulting in severe injuries to my face including a fractured cheekbone. He narrowly missed hitting my sons head, which could have killed him.

Before this there were several other incidents of violence and aggression. I also have concerns around his family (who he lives with) dealing drugs.

My son is now 3 years old and hasn’t seen his dad since that night. I applied for an interdict over a year ago when his dad was trying to contact me on fake accounts and his dad counterclaimed for child contact (2.5 years after last seeing him)

i was unable to get him charged for the assault due to lack of evidence. But I have a whole load of proof it happened including photographs, medical records and police reports.

He has denied the allegations and said he has only ever treated me with respect. He has also written the court a letter about how hard it has been for him and how he is being punished for nothing.

A proof is meant to be in a couple of months. No interim contact was ordered. What is the likelihood he will get contact? I am worried sick.

Lack of evidence? How do they think your injuries happened? Slipped and fell on his fist?
