Passport for Special Guardianship order child

I am just wondering if anyone knows if I am still able to apply for a Passport for my child? Both me and my mother are taking my child on holiday this year so need to apply for a new passport. Can I do this or does my mother have to apply since my child is under an SGO. If I apply what ‘evidence’ do I need to supply..
My child is under an SGO as my mum applied for one a years back when I wasn’t well.
I spend lots of time with my child and is living with me part time. Me and my mum have a great co parenting relationship and have come up with this agreement unofficially as my mum will not consider the termination of the SGO even though circumstances have changed significantly.. I don’t want to go against her and ruin our relationship..

Who applied for the previous passport? Normally to do a renewal for a child under 12 all you need is a new photo, a countersignature and to send the old passport back.

Why would you be going against her if you are going on holiday together? Can't you just discuss it with her?

I applied for the first passport but back then i had full legal responsibility. It says anyone with legal responsibility can apply. From what my understanding is I still have some legal responsibility.. when applying for passport it says if a child is under any form of care order you need to send the proof. I never got any proof when this SGO went through, in all honestly social services failed to update or even involve me so I don’t really know much about it.. I wouldn’t be able to send this paperwork since I don’t have it unless my mum can find her paper work confirming this

Hopefully an expert will chime in. I’m fairly certain that a legal guardian has to apply for a passport for a minor. That person is normally, but not always, a parent. So if the grandmother is the legal guardian, she would do the passport application.

@11NigelTufnel i have tried talking to her countless times about revoking it but she won’t even discuss it with me. It always ends up in a big argument and her saying I don’t stand a chance... We are very close and as I said before we co parent really well together, but if I bring up possibly of taking it back to court she just doesn’t want to hear it.. my circumstances have changed significantly since 5 years ago when it was granted. I also have another child that I have full responsibility for (with no social services involvement whatsoever) my worry is if I do try and take my case back to court she might try and stop me from having my child half time as I am currently and have done for about 2 years. She seems happy to co parent but doesn’t like idea of the SGO being taken away.. I have always said I will stick to arrangements of half even if the order is dismissed as in my opinion that’s in my child’s best interest to be with both of us.

@Ponderingwindow this is what’s confusing me, I still have parental rights- for instance I am the one who takes and collects my child from school and attends all parents evenings, pays for clothes, school trips etc.. Me and my mum are going to contact the passport office on Monday to discuss this

It sounds like you both have parental responsibility so you would both sign the form?

Could she do the application then? Although she'd need to send proof of the SGO giving her the authority to do so.

Or you do the application and give details of the SGO if she will supply them

@Unexpectedlysinglemum yes I can sign for things like school trips, consent forms etc. I’m usually the one who does this. School are aware and have never questioned it. They know the situation and are quite happy with how we are doing things. No issues or concerns.
I think both me and my mum can sign her passport but I’m thinking I might have to go via post office rather than online as online there’s no where for me to explain. Only thing it asks is who has filled in form

@Unexpectedlysinglemum example being I can call in sick to school, pick her up early from school, take her for any appointments in school hours etc. so basically like all the other parents

@dementedpixie this is what I was wanting to do but was worried in case application was denied as I’ve read similar stories.. you also don’t get a refund. I’m thinking of doing that and attaching my mums paperwork or even submitting form in my mums name (with consent of course) my mums asked me to do it as she struggles with things like this. On Monday I’m going to ring passport office with my mum present to make sure we have supplied everything we need

If you still have parental responsibility then you should be able to do it. The application is usually only completed by 1 person anyway e.g. I do the applications for my kids and provide dh's details but they don't need his signature for it.

There's usually a section at the end for you to provide any extra info so you could give details of the SGO there
