Removal of name from mortgage

My SIL split from her husband amicably a few years ago.

The mortgage is joint but she pays it all and now wants to remove his name , would she go through a new credit score process to prove she a
definitely can afford it ?

We are in Scotland if it makes a difference. Thanks.

Yes she'd need to remortgage in her name only.

Yes, as above. Hopefully the years she has been paying it has knocked down the amount outstanding enough for her to take it over by herself.

@STM1 You would be better starting your own thread rather than reviving an old one. People may post answering the OP and not notice your question.

Could you be a little clearer about your situation? Are you after an order that will force the lender to remove your ex's name from the mortgage? If so, you won't get one. That is a matter between you and the lender. Or are you trying to transfer ownership of the house into your name only?

he went bankrupt 11 years ago, I managed to keep the house and paid for his share from the trustees, the house deeds are in my name and have a deed of assignment but I never could pass the affordability test from the mortgage company but now I have. They are happy to take his name of the mortgage but solicitors said no because his name is on the land registry so he has a legal interest. I have been trying constantly now for two years but solicitors going round in circles and costing me and got no where. So been told I need a court order so the court would remove it as ex won’t agree with it. It’s a control issue
