Court order on family home

Hello
I attended court a couple of months ago for a financial hearing. The court ordered a sale of the family home in April 2024 and 60/40 split.

I have 2 children and desperate to keep them in the home they love so have been looking at ways to do that. My family have agreed to loan me some money to buy my ex out but at a lesser amount than he would get should we sell the house at the current value.

I have spoken with my ex and he has agreed to this amount so he can release himself from the mortgage quicker.

As we've agreed this outside the now sealed court order, I wanted to ask if anyone know if/how this could be legally binding so there's no comeback. Would we need a change the court order? Or do it another way?

Any help would be much appreciated! Thank youu

Hi, going through similar at the moment however is there not a clause in the court order to say either sell or buy him out? Mine had both so I had the option

Look at the court order in detail at all the clauses and stipulations

Thank you for your reply. I can't see anywhere in the order about buying him out unfortunately.

You need to amend or replace the order.
