I know I need to get real legal advice but just wondering if anyone could help in the meantime?
Myself and partner (soon to be ex) bought a house almost exactly a year ago. He moved into my flat while we saved for this, it took 2 years The savings were in his name but we both contributed. He contributed most to this but this was because I was paying all the bills in the flat. During the saving and living in the flat, we had a baby. The house was bought when baby was 4 months old. House was decorated and furnished using my existing furniture and a cash loan from my mums friend. We need to pay this back starting this month.
I did all the paperwork and stuff related to the mortgage, including making the offer. We are both on the deeds and the mortgage.
I’m currently a final year student. We agreed that he would pay the mortgage, council tax and energy bills while I’m not working. We were supposed to both pay towards other costs.
It’s been absolute hell trying to get him to pay towards anything including money for our child. He has an older child from his marriage, he gives her £200 a month. I’ve dealt with everything to do with our baby, finding childcare, buying food, nappies, wipes, anything she needs, I buy. I accessed funds from uni to pay for a portion of her childcare. Trying to get him to pay towards the rest was always a fight. I gave him a loan of £1500 to buy a car to facilitate him getting to his job. I don’t think I’ll ever see this money again.
I pay for most of the food for us, I do most of the housework, I pay the house insurance, Internet and streaming. My family facilitate childcare due to me being on placement and having to do assignments in the evening. He rarely does childcare.
He has not been supportive at all, he hasn’t picked up the slack in any sense of the word while I’m trying to finish the last 3 months of my degree.
It’s come to a head and I would like him to leave but he is refusing. I’ve offered him his half of the deposit to leave but he won’t take it. I’ve seen people saying about forcing the sale of the house. Could anyone tell me if this would be possible? And would the fact I’ve not paid the mortgage yet be taken into account?
