Old estate agent using pics of my flat on another listing

I sold my flat through a local estate agent a few years ago. Today I noticed there was another flat in the same block (but different floor) for sale so took a look. Half of the pics are of another flat but the photos of the lounge and kitchen are clearly from my flat (I don't know why as thr kitchen was in dreadful Shape and since I added some drawers etc won't look like any other flat).

I'm not gonna do anything about it but just wondered on the legality of this.

It’s happened to me, although I was the tenant not the owner - still all my stuff though! Had a good laugh about it, didn’t think to question if it was legal.

Copyright in the photos belongs to the estate agents unless you took them yourself. They can therefore do what they want with them. However, using them for another property may be a breach of the Consumer Protection from Unfair Trading Regulations. Trading Standards may be interested.
