Ex wont buy out or sell jointly mortgaged property

Me and my ex parted in 2021, he moved out of our joint mortgage property in February 2021, me and our two children stayed in the property and I started paying thew mortgage on my own until a domestic happened in the September
at the property so me and the children moved into my mums for 6 weeks until found a property to privately rent, wave started a fresh which has got me into a lot of debt. He has been living in our jointly mortgage property since the September.

He will not agree a price to buy me out and will not sell the property, I had a solicitor send him two letters, one regarding set days for the children as would never commit to days and the other letter asking for three valuations to be done on the property. I feel completely stuck, its been a very toxic year

I just want closure so in can move on but now im stuck on what to do as cant affords to take him to court

It’s an awful situation and I have a friend in a similar position. Hope you get some answers soon OP.

What is your lawyer saying, as his will likely say the same.

Had he been paying the mortgage?

Surely there's some legal procedure in place for this, it's not an unusual situation (unfortunately).

If there's a police record of the domestic you could get an order to remove him so you can move back in.

When you say a domestic happened in September - depending on the situation you could try contacting Women's Aid and see if they can help?

Unfortunately unless he us willing to sell or buy you out then it will have to go through the courts. Are you married? Oh, and check with your mortgage provider that payments are up to date.

Forcing a sale is the only option, although you might hope that when he realises the wheels are in motion he stops being an idiot, saves a fortune in legal bills and just gets it on the market.

No,it has to go through the court. A judge will order the sale if they think that's the fair thing to do.

Place this in the hands of a solicitor, they’ll know the process and will manage it for you.
