I've managed to find a v good Solicitor to take on a transfer of legal aid certificate, it's in process at present - we've been notified of a hearing at the end of this month and I'm just curious as to how long it normally takes if there is a standard answer? my previous Solicitor has not opposed the transfer and has been fully co-operative.
The hearing we have at the end of this month is for enforcement action that has been applied for on an urgent basis. I have stopped interim contact on the basis that death threats have been made to me and there is currently 3 separate investigations underway, the Court is not aware of this at present - how will we get the Court to be aware of this information? we're not permitted to submit anything in advance, i.e. statement/bundle etc.. is it simply a fact of the Barrister quoting the crime reference numbers in the position statement and making the Judge aware?
Notwithstanding this, we were due to start in a new contact centre of the other sides choosing, they made me aware that they couldn't facilitate waiting times, there is a term in the order that requires the applicant father to arrive 30 minutes before and 30 minutes after during his violent stalking past (present) and that I would have to see him at some handovers depending on how busy the centre is.
DD is now under the engagement of children's services who have advised me not to take her to contact on the basis of these death threats, however there is no way to notify the Court of this.
What do we need to be asking the Court to do?
I haven't had my LA certificate transferred over yet so can't engage with my Solicitor as of yet.
