Assault sentence

Any legal people that could give me an idea what someone might get if found guilty of assault by beating?

I don't know anything about the legal system so wouldn't like to even guess, and I know more serious offenders have walked away from much worse so I'm guessing it's not a custodial sentence?

Prison is about rehabilitation in the UK. She'd be required to to offender courses that look at her behaviour, for reflection and understanding.

She would also possibly learn the lesson that there are severe consequences for severe actions. Prison can sometimes be a place of reflection.

She would also be able to be put on pathways for support after release such as drugs and rehabilitation for addiction. Mental health diagnosis and treatment. Behavioural courses, help with education and learning. Help with housing.

Don't get me wrong she could go in there, do nothing, not engage and then come out and do nothing and not engage. Nothing will be lost but so much could potentially be gained.

Well, if she doesn’t turn up there will be a warrant out for her arrest. She may well get remanded until the next available Court appearance. I am very surprised that a Pre Sentence Report hasn’t been ordered for a female at risk of an immediate custodial sentence.

OP in terms of being protected from future behaviour once there are no bail conditions, I suggest you speak to the police/CPS urgently before the hearing. It's possible to get a restraining order issued by the criminal court there and then.

If you don't do that you'll have to go for the non molestation order and that is a whole separate court case, if she doesn't agree it can take months and months to put in place and will often be for a shorter duration than the criminal court restraining order.

But this has to be sorted before the criminal proceedings are over. So act quickly now in the hope of saving a lot of hassle down the line.

@Elbie79 the case isn't mine it's bought by the cps who have already requested a restraining order based on this conviction and previous history (long line of assault and harassment)

Forgot to revisit this; my daughter didn't turn up to sentencing 25th October a no bail warrant has been issued, it's still not been executed which I can't understand

She's not even trying to hide she's still convinced she's done nothing wrong

It's deeply frustrating

How frustrating to have this hanging over you, @Cait73! Not least because she must feel she has 'got away with it' given no-one has yet come to arrest her. Does this mean you still don't have your restraining order? Are you still being harassed? I hope you're reporting every incident to the police so it's obvious she is a danger to you and your grandson.

@tribpot nope still no restraining order, yes the harassment continues and yes I'm reporting it, beginning to wonder why I'm bothering though tbh

I’m sorry but prison is far from what you describe on here.

I have very recent experience of this with my son.
There is no rehabilitation or education available anymore for short term prisoners.
Lifers maybe but not for transient prisoners.
There’s barely any MH or addiction support.

It’s shocking how bad it is.

@Cait73 given this impacts on your grandchild you could raise it as a safeguarding issue with your local multi agency safeguarding hub (MASH) which is a combination of social services, police, education and health. They may help get the reports of harassment acted on.

@Almostmenopausal indeed and I know "it'll all catch up with her" and "she can't hide forever" but I've been stuck in this living hell for over a year now I'm wrecked

It's all consuming and I've got far more important things I should be dealing with, like the small matter of her beautiful amazing son

EVEEY day I wake up thinking "today it'll end" and about this time every night I accept I was again wrong, and so it goes on

@alexdgr8 thank you, I was just talking to Devon & Cornwall Police who are really struggling with Kent Police, they have the warrant but haven't yet actioned it, no one knows why
