Has anyone else been in my position?
50/50 care of the children and ex husband remained in family home - the agreement on the consent order was that he would use best endeavours to release me from the mortgage. (The consent order was never stamped in court) That has never happened and we are now 8 years later.
I'm unable to secure my own mortgage due to this. I am going to start a financial application in court and ask the judge to force the sale of the house.
All I can find on the internet is that the resident parent keeps the family home until child is 18, obviously children have 2 shared family home 50/50 and I'm stuck renting unable to get a mortgage.
Anyone else been in this position?
