Car Parking - Small claims court

Hi,

I sold my old car via auction in May 2020. I sent the V5 to DVLA and assumed that was the last of it.
A letter was sent in December to an old address for a parking fine. I didn’t see this letter until March 2021. I then contacted DVLA who confirmed they had removed my details as the registered owner.
I then received another letter for the parking fine this time at my current address and have now received a notice from the small claims court.

I have provided details for who I sold the vehicle to and shown the letter which states I am not the registered owner so why are the parking firm still going after me?

They have refused mediation and wish to go straight to court - Can I actually be prosecuted for someone else's parking fine?

I should also mention I live approximately 70 miles away from the car park and the UK was in lockdown so noway was I travelling that far as I was 4 months pregnant!

I received the notice and stated I replied online acknowledging the claim and stating I disagree with the claim.
I then received a questionnaire and without prejudice offer letter from the parking company today

Was the questionnaire from the court? @Comefromaway has posted the link to the DQ I was aiming for but it sounds like you might have just acknowledged rather than filing a defence? Again I don't use the online money claims system so not sure of the process.

I think the SC Response Pack has a Defence section, so you can acknowledge and deny in one go.

It is the DQ where you tell the Court where you'd like the claim to be heard and why.

Hi,

Just an update. Attended small claims court and provided the exact same evidence to the Judge that I did to the car parking company.
Within 5 minutes the judge dismissed the claim and ordered my costs to be paid!

The Judge said it was a very simple and straight forward case and it was obvious from the evidence provided I was neither the owner not the driver.
