My purchaser's solicitor has identified a breach of covenant on the local authority search on our house - apparently a breach of footpath (there is one beside the house) in 1986.
We've lived here since 2017, and there is no mention of it in the searches conducted when we bought it - I've been through all the paperwork and it doesn't come up at all, I can't even see it in the transfer of title dating back to 1996, 10 years after the supposed breach. There is a concrete bollard at the entrance to the footpath which was apparently put in years ago (according to our neighbours) because people kept parking across it.
My solicitor has contacted the local authority to see if it can be removed, or if they will confirm in writing that it no longer applies.
I don't know how my original solicitor could have overlooked it. The only indemnity policy I can see in my papers is something to do with insolvency, signed by my solicitor then (I used a different one this time).
Should I be worried, what happens now?
