Financial Order (divorce) - can't obtain a chartered surveyors valuation

Evening all

I am currently going through a divorce and have been issued with an Order (off the back of an FDA) to provided a chartered surveyors valuation for a buy-to-let property I own with my ex.

The judge said that an estate agent's valuation would be insufficient as the buy-to-let is in a block of flats that has problems with it's cladding. Remedial works are required (there is no timeframe for this), and therefore the block of flats does not have an EWS1 form to say that it is safe.

I contacted a chartered surveyor today who advised me that almost all chartered surveyors would not give a valuation on a property that does not have an EWS1 form, as they wouldn't be covered by their indemnity insurance.

I'm really at a loss as to what to do. Has anyone else found themselves is this rather unfortunate position?

Yes there seems to be no end in sight, especially as there are no enforcement powers to make freeholders carry out remedial works.

The chartered surveyor said that he cannot even give a value £0 as they wouldn't even carry out a valuation in the first place as it doesn't have the EWS1.

Write to the court and explain why the order cannot be complied with. Also, I presume it's intended to be a joint instruction rather than you get it all on your own.
