Help please - found a charge on my house - how do I find out what it is?

I downloaded the Title Register of the house as I was thinking of selling. There's a mystery entry under the Charges Register section:

(15.05.2004) REGISTERED CHARGE dated 17 April 2004.

I've no idea what this is, I don't think it's the mortgage company because they're the next entry on the register dated 3 years later.

How can I find out what this is and would it stop the house being sold?

Thanks

Does it predate your purchase of the property? If so, it could be a mortgage of the previous owner which has not been removed.

That's the complicated bit. I bought the property in 1997 with ex. He moved out probably around 2004, the year of the mystery charge.

However I bought him out of his share of the mortgage then and remortgaged the house, probably in 2004. Not sure why the current mortgage company has the charge dated 2007, not 2004 which is when I think I took the mortgage out.

I'm hoping it's not that the ex has any claim on the property but how do I find out?

Both entries relate to the same thing. There's only one charge. The lender is in a separate entry to the details of the charge. Every registered charge has at least 2 entries.

Did you get legal aid at the tibe of your divorce?

treesandrocks · 23/08/2020 13:29

@starlingsintheslipstream Thank you. If that's the case then that's a relief. But why are the two entries 3 years apart, if they are the mortgage company?

@RedHelenB We weren't married. I used savings, my parents helped and a higher mortgage to pay him 50% equity and the property is in my name only.

The mortgage company entry will probably be a different date because it's changed it's name at some stage.

It has got to be this. This is the only time I see two entries on different dates for the same mortgage.

The mortgage company has changed it's name several times, so that's probably it.

Thanks, you've put my mind at rest.

The charge holder’s name etc should be mentioned. Check online to see if the name appearing there is associated to who you think your lender is. Might be nothing, but you could have a debt registered against your property that you know nothing about (I know of someone who’s husband forged her signature on a £20k loan before buggering off to Thailand. The first she knew about it was when she was trying to sell and the solicitor saw the entry) Did you remortgage at some point?
