In contempt of court?

Hi there,

I'd appreciate your advice on how to proceed please.

We have a court order dated Feb 2018 instructing immediate sale of the former matrimonial home.

My ex managed to obstruct putting it on the market until Nov 2019 when my lawyer wrote to him implying he was in contempt of court and I'd secure a penal notice if he didn't sign with the estate agent.

After 55 viewings we now have a cash buyer who is offering the asking price.

My ex is not accepting the offer. But given that we have a court order in place and it's my house too and I accept the offer - can we proceed with the sale despite that?

As surely he would have to prove that was wrong- yet he has no legal grounds to do so?

What do you think?

You need to apply to the court for an order that the judge signs the transfer deed instead of him. Speak to your solicitor about getting that done quickly.
