Hi,
I've been seeing someone who has had a confiscation order but still has a POCA for £1 million. He's told me that he can't have any assets until he has paid it off but that he can only pay it off in one go, so clearly that's not going to happen. Is this true? It just seems a bit odd that they wouldn't accept any repayment until he has the full £1m. Is he playing the system and me?

POCA order aren't always forensically accurate. They're also predicated on some interesting notions.

If you grow your own cannabis, and only ever consume what you grow, but the CPS manage to get a production rather than cultivation charge, and a POCA order (they have been known to forget), then even though you never received a penny from anyone they determine that because you didn't spend £x to a dealer, you have "profited" by £x.
