I'm confused be this, this is the first I've approached the court about finances but not the first time I've approached the court in general as I already have a Nisi?

Are you applying for an order by consent in terms of written
agreement (a consent order)?

Im applying to force my husband in dealing with the finances, would this be No at the moment as we haven't got that far?

If your application includes an application for a property adjustment order in relation to land, please
give the following details, if applicable

We are talking about our house, do I need to fill this in?

If an application is made for any periodical payments or secured periodical payments for children,
please complete this section.

Don't know what that means, all I have is Child maintenance paid through the CMS, so this stays blank?

If none of the above applies, the court may not have jurisdiction to hear the application for
periodical payments.
Has the Child Support Agency made any calculation of maintenance in respect of the child(ren)

Is the CSA the same as the Child Maintenance Service, I get monthly payments via them. I don't think this is Via court though so I tick No?

Should I include my daughters details? Im only looking to sort out finances including house, savings, pension. Possible outcome could be a trust!

If you did your divorce yourself you completed form D8. Question 10.1 asked if you wanted to apply for a financial order for yourself and/or your children. If you ticked the boxes you are now proceeding with the application in the divorce. If you didn't tick the boxes you are applying to the court (i.e. the first box).

Correct. You haven't got an agreement with your husband so there is no draft order at this stage. You therefore have to say no to this question.

Yes.

Yes unless your husband is a very high earner or you need to arrange for him to pay private school fees.

Yes, the CMS has replaced the CSA. However, you don't tick either box. This is still part of the section you only complete if you are claiming child maintenance.

When answering the question on page 2 about which orders you are applying for you should tick all the boxes except maintenance pending suit. That means you are applying in relation to your children - specifically, a settlement or transfer of property for the benefit of your children. So yes, you should include your daughter's details.

Thank you so much for replying I really appreciate the help @ prh47bridge. when I applied for the divorce I didn’t have a lawyer then and in shell shock from abuse. I ticked no to a consent order as I was going to leave him everything and run. Obviously came to my senses! Thank god ticking no wasn’t permanent!
