I have an abundance of evidence to prove my ex is violent, an alcoholic, uses drugs and is severely mentally unstable. Images, videos, voice recordings and text messages and police reports. The list would be too long to write out, but the evidence is extremely shocking and definitely shows that he is all the things above. I stopped his access to my child after he assaulted me (not for the first time) whilst I had hold of my child and then again in front of my child in October 2019. I reported to the police and he was now been found guilty of “assault by battering” after denying it all the way through. The judge finished the court by saying “although this is a first time offence the injuries are that horrific I’ve not decided about a prison sentencing yet”. He was due to go back for sentencing however it has now been postponed due to coronavirus. I have a number of messages from when I was pregnant telling me to “kill the baby”, he threatened to kick my head in when I was 6 months pregnant and after my child was born, throughout he hasn’t been consistent and said that my child doesn’t need a dad (again all on text messages). I have a report from my child’s nursery that says my child was impacted due to him assaulting me whilst I was holding my child.
Yesterday nearly 7 months after I have received a phone call from CAFCASS saying he has put an application in for visitation to my child. Every other weekends and one evening during the week.
I am going to fight as much as I can as I do not want him anywhere near my child who 18 months old and now after no contact for 7 months won’t even know who he is.
I’m wondering if anyone has had a similar experience or can offer any advice on what you think the court might give him? He hasn’t changed his ways in the 7 months (again I have evidence) and is now in a relationship with a woman who has a matching criminal record to him and has lost custody of her own kids.
