We bought a property in 2018 which is detached. Our neighbours had a gate down the passage which was attached to our wall. They removed this gate when they had building works done. Two days ago they erected a new gate in a new part of the passage. They own the passage but we own the wall. Therefore the new gate is not in the same place as the old gate. Whilst I have no issue with them having a new gate I have an issue that it’s in a new place, that they didn’t tell us they would be drilling new holes into our wall (the screws are into the mortar if that makes a difference) and that I do not know if they have filled the previous holes. Where do I stand legally? We have taken photos and spoken to the neighbour. They said they didn’t think it would be an issue as they are just replacing a gate which was already there. But in my opinion it is not a like for like swap as new holes have been made.
I do not want a neighbour dispute as we are planning works to our house in the next few years which we would need access onto his property, otherwise it’ll be more difficult.
My issue is that near where they have drilled we already have holes and surely the extra holes add extra weak points to the wall where it can crack?
Please ask if there is any other information which might help. The resolution we want is insurance details from the company with a letter from them to confirm if any damage happens to our wall which is proved to be the result of this new gate that they would cover it. Is that reasonable?
