At wits end with CMS is there any other Avenue I can go down?

I have a few threads floating around regarding the CMS. The latest is that the military are not sending over any money through the DOE request and the CMS are saying that if they don’t there is not much more they can do.

I’ve researched and it seems they can do down other avenues such as regular deductions from
The bank etc.

I’ve written ANOTHER complaint but just wanted to know if there is anyone else to contact. I’ve sent a copy to my MP (BoJo and he hasn’t replied to my last 3 emails regarding this). Is there anyone else who holds any weight?

Is there such a thing as a solicitor who can try to deal with the CMS/Military regarding this?

I’m honestly shocked this is still going on (2 years next month)

Is there a reason the military wont take it out? I understood it was seen as a bad thing for someone serving to get to this stage.

I cannot offer any advice but I have found them dreadful, absolutely awful. Just sympathy.

They seem really reluctant regarding enforcement actions. I have a liability order but thousands of arrears have built up behind this and they wont apply for another one until the first is paid and yes, they have given him two years to pay on a debt outstanding from 2016 so six years in all.

He has now said he is going onto benefits. So I rang his employer who confirmed he still worked there! However, CMS are taking it seriously.

My MP has also not got back to me despite me visiting him as well.

I hope someone comes on who can give you some advice. The problem is the complexity of the rules, lack of initiative and lack of thoroughness amongst the staff even at Legal Enforcement level where they appear to view themselves as an elite. Sorry, its just the same.

@RedHelenB they did briefly last year (case is so messed up they cancelled it and reapplied for it). Apparently the boss can put a hold on it if he’s concerned about the welfare of the paying parent. He would have 100% been crying crocodile tears to him, I can picture it. It’s awful because there is no consideration to the welfare or finances of the household keeping a roof over the head of the child. It also doesn’t prevent the CMS from chasing payment. If the military won’t comply then they will go directly back to the paying parent. The CMS have omitted to tell me this though.

@ElsieMc I’m sorry you’re having difficulty too. Honestly how difficult is it to have some pride and contribute towards your child?! I honestly just can’t get over the incompetency and lack of consistency with them. The fact that the person who answered the phone automatically becomes your case worker is appalling- they can’t see what other people have done if it’s not been updated- mine actually asked if I have reported that no maintenance has been received- I’ve phoned about 50 times over the last two years!

I don’t understand why they don’t have a specialist team to deal with the military (as they are apparently so complicated!) and more complex cases not referred to a more experienced case manager to handle and to provide some consistency to the receiving parent.

I can’t help but think that if it were largely women as the paying parent then

  1. the CMS would likely not be required
  2. the CMS would be a lot more aggressive with their enforcement!
