Just got lease car today - now need legal advice please!

Hi all,

Googling and going through contracts but can't find any advice on my car lease issue.

Problem is we got a lease car delivered today and it's missing the privacy glass we were told by the broker it came with.

Obviously emailed the broker attaching his email saying the privacy glass came as standard, again he said he believed it was standard and would look into it. The dealer then confirmed that the glass wasn't standard - so the information we were given prior to signing the contract was wrong.

The broker has held his hands up and said he made a mistake but there is nothing he will do about it. He said if we decide to give the car back we can instigate the cooling off period - which actually we can't as that is 14 days after signing the contract and the contracts were signed almost a month ago.

Point is, the dealer hasn't made a mistake and supplied the correct car, but the broker has mis-sold the car to us and seems to think they can get away with doing nothing.

So we're are now stuck with a very expensive car for 3 years that isn't what we wanted. It might just be privacy glass but for me it's a big deal!!!

Any advice as to rights?

Ps. We are in Scotland but he broker and dealer are in England. Not sure if that makes any difference in legal terms!

"Drug dealers' cars" have really dark windows. I think the OP means the 'standard' tint, that many cars have. You might not even notice it unless it's important to you. I just had to look out the window to check if mine has it. Turns out it does, but I wasn't aware.

Wow there are strong thoughts on tinted windows. It's just the rear ones not everything. And I'd say don't knock it till you've tried it - super practical especially with kids.

But that isn't really the point. We didn't get what we were told we would get. Still waiting on a reply from the broker...

Just to repeat what I said up thread, if the broker was acting as an agent for the finance company (which is normally the case), your contract is with the finance company and they are responsible for the broker's misrepresentation. In that situation the broker is not liable - the finance company is.

I think people are getting a little mixed up about what tinted windows actually are. They're not all around like a chav car or a dealer's motor. You can see through them just not as clearly. And it's just the back. Totally normal front windows and windscreen.

OP, I'm so happy for you. Sure it's small in the grand scheme of things but can really take the shine off a really exciting new investment.

@MarySibleysFamiliar awww thank you. Yeah I was so excited about it arriving, did take the shine off. But now looking forward to a weekend of discovering it and all its gadgets and gizmos!!! X
