Builder wants to move fence- taking away some of our garden

Does anyone have any experience here.
We moved into our new build home at Christmas last year and it was discovered last month that the fence was erected incorrectly and now they want to move it taking away some of our garden.

Where do I stand here? Should I consult my solicitor that dealt with the purchase?

We are with a small new homes builder, not massively well known.

Yes, go back to your solicitor, but first check your documents to see if you agree that the fence is in the wrong place.

Definitely go back to solicitor who dealt with the purchase for you. Also advise your Bank as they have an interest in the property and you have to give them notice under your mortgage.

I would be arguing that you bought what you saw and the builder should suck up the loss. Check your deeds, is there a boundary plan?
