If on divorce your (ex) spouse agrees that you can stay in the marital home and continue to split the mortgage each month would they be able to force a sale once the child living in the marital home turns 18?

I don't know all the ins and out and this is mainly curiosity on my part.

Normally it's set out in the divorce. And will, often have a section about full time education rather than 18yo. Might specify finishing year 13, or even uni.

Thank you. Dc is going to uni so that might change things.

Yes, there's an argument that the dc still needs a home in the holidays, etc. A uni address is only a term time address.

But sometimes there's an agreement that the house will be sold at that point and the dc has to accept when they come home in the holidays it will be to a smaller house. Guess it depends if the resident parent could only afford a 1 bed house.....? If so it would seem unfair to force a sale?
