Partners surname changed as a child by deed poll, now we're getting married what do I do?

My partners surname was changed by deed poll as a child. His name on his birth certificate is his old one. The registry office have told me it will be his old name on the marriage certificate but he will be referred to by his new one in the ceremony. I want to change my surname to his new name, however now won't be able to use the marriage certificate as a proof of name change, will I have to change my name by deed poll also? Or can I use my marriage certificate and partners deed poll document as proof of name change? He's had it done by a solicitor at the age of five and his passport etc are all in his new name so I'm not sure how it will work, any help is much appreciated!

But if that's the case it would be easier for you to change your name by deed poll. You don't need to pay or to use a solicitor, just Google "free deed poll uk" and it will give you a template you can use.

If he has proof of his deed poll change he can have his current name on the marriage certificate. I've done this myself so know from experience.

When you go to the registry office to register for marriage he needs to take his birth certificate and his deed poll paper work.

Does he have a passport and proof of the deedpoll change? When I got mine registered to be married they were happy with my new name as it was changed when I was under 18 and had photo id in that name to prove who I was. No mention of the old name

Thanks for the replies! I don't know whether it makes a difference but we're getting married in Scotland so we've sent them the deed poll certificate and birth certificates along with our M10s and I rang to confirm they'd received them and this is what they've told me. I didn't get a chance to ask many questions as I'm in work so didn't want to spend too long on the phone but I probably should call them back tomorrow!

I'm not sure how it works re marriage certificate but I know deed poll isn't recognised in Scotland.

I wanted to to change DS name (9yrs). We could only apply for a variation of his birth certificate rather than deed poll. It was fairly simple and quick to do, and has his previous surname recorded but legally he now has our new name.

I'd phone National records for Scotland. They're fantastic at giving correct advice and the deal with the marriage certificates & registration for Scotland.
