I don't know what to tell the CMS

My stbxh has played every trick going with the CMS.

Over the last year he has paid his CMS money in 2 or sometimes 3 deposits.

I had thought the smaller of these amounts was for spousal alimony. At some point this had been said in a solicitors letter written by my stbxh's solicitor.

The CMS want me to state what I think the separate deposit is. Is it for the children or spousal maintenance?

My stbxh says it's for the children.

What should I say? Once I've decided I can't change my mind.

I've asked my solicitor and haven't heard back. That was weeks ago.

Then tell them it's spousal alimony and send them a copy of the solicitors letter confirm this. And tell them you want collect and pay now.

Thank you for replying. I've already sent them a copy of the solicitors letter. Yes I'm desperate for the money. He is already on collect and pay but he keeps putting enough money in my account that it is slowing down the chasing him up process. They've told me to close my account so he can't give me anything without going through them but i can't afford that til my new job starts in January.

Can it be a contribution to what he said he would pay as spousal alimony? I'm not feeling it to be a total amount?

CMS don't get involved in SM (Spousal Maintenance). SM can be agreed mutually or ordered by the Courts.

Is there a Court Order in place for SM? Or is it just something suggested by Solicitors as part on ongoing negotiations?

If your solicitor is has not answered you after several weeks that needs looking in to.
