Ex's D8 Divorce petition sent to old address. He didn't tell me he moved.

Has a similar experience happened to you?

I completed a D8 online last week.
My ex is in rented accommodation and I used that address. (He sees our son about once a week for half a day. (At my exes request)) My 5 year old son told me yesterday that his father has a new house. I didn't want to make a big deal out of it so I just asked a couple of questions.
'Oh, why did he move?'
'Because his house was too old. Our house is old. Can we have a new house mummy?'
'Our house isn't old. Does anybody else live with him?'
'No, just Daddy.'
And that was the end of that.

Now my ex hasn't told me he's moved. It's not 100% he has. Though I suspect it could be true. He's kicked off now he has to pay child maintenance and says he can't afford it. He was living in a 3 bed house which seemed ridiculous. I'm assuming he's downsized.

What on earth will happen to the divorce petition? The thought of messaging my ex and asking him if he has moved fills me with dread. He will not answer directly and start a game of cat and mouse; saying I do this... so he can do... Eventually after a week of him getting off on our argument he will give the address (I think).

Whats going to happen to the petition if it gets sent to his old address, as he's moved? Is there anyway for me to contact the court and give him his work address instead? He will go mad at this, as he'll say I am doing this out of spite and his colleagues will know.

I just want to divorce this guy asap. He's a controlling, abusive man.

Thank you for any advice.

xx

Ask him to confirm his address. If he doesn’t you need to serve the petition personally at whatever place you can send a process server.

Thanks. I don't want to ask him as he'll just play games with me. I guess I was hoping you would answer; not to worry as the divorce will just go ahead if he doesn't get it. Stupid I know. x

No it won't. If he doesn't respond to the petition you will need to prove that he has received it.

He may well have his post redirected for a while so it may just be forward to his new address
