Can exh appeal financial order from divorce?

Following an fdr hearing in January, we agreed a court order which would give me 55% of the profits of the house when it sold. Exh is living in the house with his girlfriend and it’s finally in the process of being sold now, after nearly a year.We have now just had the final hearing of a child arrangements case where he got an order to have the dc’s 50% of the time. He has been very angry about the outcome of the divorce and has taken me back to court once already for my perceived non-compliance with the financial order. Is it possible that he could now appeal the financial order to get a greater share of the money now that he has the dc more?

He would have to get permission to appeal, and permission to appeal out of time.

It is extremely difficult to appeal against a consent order, for obvious reasons!

So the fact that I made completely full disclosure at the time of the fdr and the only change is that he has taken me to court to change child arrangements would make this unlikely? I have been planning to buy a small house for dc and myself and i’m Terrofied that this might not happen now that I have already spent so much on legal fees.

From what you say, highly unlikely!

In any case, you need as much house to have the children 50% of the time as 75% so no change in your needs.

That’s positive, thanks
