Neighbours extension but no party wall agreement.

We are an end terrace and NDN is currently extending the back of their house. I think the extension will fall into the permitted development so they won't need planning permission. We have no idea though of what the extension will be like! We've not been shown any plans and possibly more crucially we haven't signed or been given a party wall agreement. I've had a quick look at the act and think it could well apply (extension will be tiny if more than 3m away from our foundations). But because we've not seen any plan's we've no idea and no idea how far down they'll have to go for foundation's. I don't particularly want to fall out with them but I'm getting twitchy! Do I need to be worried and taking some action? Thanks.

I thought you only needed a party wall agreement if you build right up to your neighbours wall?? Not heard of a 3m rule before?

May well have misunderstood the act (building law way outside my usual reading! but it seemed to be saying if you build/excavate within 3m to depth of non extending house foundations you need party wall agreement. Happy to be proved wrong tho!

You're right. Go and ask them what they're planning? Doesn't mean you need to fall out at all but maybe they've not realised.

We were planning an extension recently and though we've stopped plans now I didn't know we needed an agreement and the builder never said either.

Thanks, have bravely volunteered DH to go and talk to them and will take it from there. Had hoped if they needed ok t the builders or who ever drew up the plans would have realised.

If they don't think the PWA apples then ask them to show you their plans. You should take a copy to your surveyor (if yore unsure whether the Act applies) and ask them to comment. Choose a PWA specialist surveyor.
