Anyone know the legalities of someone being offered a job who doesn't meet essential criteria?

In the nhs if that makes a difference. If I was the only person interviewed who I know for a fact meets the essential criteria but someone else got the job? Would it be a defence for the hospital to say the essential criteria was a mistake and the thing in question should have been in desirable?

Do you believe you were discriminated against on grounds of age, sex, race or similar? If not I'm afraid you don't have a case. An employer is entitled to take on the person they believe is the best candidate for the role even if they do not meet the advertised essential criteria as well as another candidate.

No, don't think there was any discrimination. Thanks, good to know its not worth kicking up a fuss.
