Hello. I do hope someone can offer me some advice.
12 years ago we went through a spate of having lots of graffiti and damage to our fence which backs onto council parkland/open space. We then reached an agreement with the council whereby we would buy and plant 60 blackthourne and pyracantha on council land next to our fence and I was to be responsible for maintenance. All good.
The following 3 summers their gardeners came along and cut them at ground level! Each time the manager was very apologetic and paid to have them replanted.
Anyway, all has been fine for a few years and they have grown to cover our fence. Until today....
I came home to find they have all been cut to about 2ft tall. I immediately phoned the manager at the council who has basically said that it is council land so they can do what they like and that the agreement we had was too long ago so is now invalid.
Unfortunately I cannot find my agreement letter as it is filed somewhere unknown at present! However the manager said that me finding that letter changes nothing as it is still council land.
Can someone shed any light on this, please, and let me know if there is anything I can do at all?
Thank you so much.
