Damage on old furniture invalidating warranty on replacement furniture?.

We bought a mirrored dressing table off eBay, the panels went black and corroded. The seller replaced it in September of this year.

The new item they replaced it with is now corroded too, they are saying our warranty is void because the old item was damaged (dh walked into it and smashed a panel when it was in our hall waiting to be collected).

Is this true? Does this now invalidate our warranty?. We've only had our replacement two months.

It potentially gives them a claim against you for the damage to the original item but it does not take away your Sale of Goods Act rights.

Really? The original table couldn't have been resold anyway because areas of black corrosion had developed in three different areas.

I assumed the manufacturer would have refunded them for faulty goods.

The smashed panel may have reduced their ability to reclaim from the manufacturer as that clearly isn't a manufacturing fault. But the important point is that your Sale of Goods Act rights are intact so you are still entitled to a repair or replacement of the new dressing table.

I'll press on with ebays resolution process/trading standards & stick to wooden furniture in future.
