Can I set up a funeral care plan for my Nan?

I am her nomiated person and the DWP help set this up when my Grandfather died. I do not have a power of attorney for her. I have not had any issues so far.

My Nan does not have a will and has dementia and is living in a care home. The social worker is meeting with family and the home to consider a move due to her deteriorating health. It has made me and my sister consider what will happen when she dies. Our mum was an only child.

We know that without a will there could be delay in releasing of funds to pay for funeral costs and we are not in a position to pay up front.

What is the best course of action that keeps me on the right side of the law?

Do we leave it until it happens and the invoice goes to the solicitor or can I use the money I have access to (but hardly touch as her needs are few) to pay for a funeral plan up front?

Any advice would be welcome.

my understanding is that a funeral plan is an expensive way of doing it. Talk to the solicitor to work out a plan of action when the time comes.

  1. Deputyship order so that you can manage her funds properly
  2. Statutory will to speed up estate administration

Speak to a solicitor who specializes in dealing with elderly clients. They will be able to advise you as this is a very common situation.
