ExP due in court for sentencing tomorrow, what can I expect?

My now ExP assaulted me and left the house. I called the police and they and the ambulance service arrived to assist me. Whilst they were with me, he returned and attempted to drive away whilst drunk. He was arrested and charged with drink driving and later given a caution for ABH (not charged with GBH which they were dying to do as nothing was fractured).

He's been banned from driving for 24 months, but due in court tomorrow to receive a custodial sentence or community service.

Any idea what he's likely to get? Seven year history of DV and ABH cautions, and damage to possessions.

Thanks

I don't get it. If he was given a caution he won't have been prosecuted. Is he being sentenced for the assault?
There's so much that goes in to the sentencing decision. Severity of the offence, history of offending, etc. impossible to say if it would be custodial, but unlikely to be immediate custodial if first offence.

What is he being sentenced for? And are you based in London?

In addition to collaborates questions

He's being sentenced for drink driving, but all his previous police records were seen by the magistrate.

Yes, London.

I might be wrong but I thought they could only sentence for the crime he's been prosecuted for, in this case drunk driving. Not the dv although that might impact slightly on the length.

Has he got precons for driving offences, drink drive in particular ? It would be very, very unlikely for him to get custodial for DIC.

My money would be on extended ban with requirement to retake test, a large fine and some costs.

He is being sentenced for the drink drive alone. If he has been cautioned for the dv that is the end of the matter

20 months ban and 70 hours CS, the fool.
