Does my ex have to pay my back rent?

Hi, I wonder if anyone knows the answer to this. My kids and I are living in a rented house, I have been paying the rent for this house on my own since we left my ex, 2 years ago. My ex says he won't and doesn't have to pay my back rent? Is this true?

Whose name is the tenancy in?

Does all of the arrears relate to the period when you were living together?

What stage are any proceedings at, eg have you been served with notice to quit based on arrears?

The tenancy is in my name. I began renting this property when I left him. We have small children together so doesn't he have to provide for them? I am working full time in order to pay the rent and have been doing so for two years without a penny from him.

Well no, he has no legal responsibility to pay the rent, you're the one with the contract with the landlord, but he does have to pay child maintenance of 20% of his net income. Contact the CSA straight away.

If you are married, you may also have a claim for spousal maintenance.
