enviromental protection letter

I have received a letter from the council from when I was away on holiday.

The police and criminal evidence act 1984 investigation into unauthorised deposit of controlled waste on land

I have to go for an interview and advised to get legal council.

After thinking about it I realised it must be about me dropping a tissue in a lay by
I remember because it was the only time I have done such a thing. Hence name.

I know its no excuse but we were in a huge rush to get somewhere the hedge was full of rubbish and to my shame I thought one piece would nt make much difference.
It will be over a 3 hour round trip is there anything I can do.
I am happy to pay a fine go down in the holidays to do community service but I really dint want a caution on my record or have to go to court.

Also show I be totally upfront and say is this about the tissue or wait to see what they have to say.
Any advice would be greatly appreciated thank you for reading

thank you prh it just feels wrong it, would have helped i think if she hadn't have been so rude.

i suppose we have no choice but to let it be kept on record.

Hi - I agree just leave it now.

The lady you spoke to doesn't sound like she really understands what shes talking about.

You can't say that you want it taken to court to prove your innocence, it's up to the the Council to A) decide to take it to Court and B) Prove you are guilty when they get you there. They have very little evidence, so court is out of the question.

The warning letter is standard in cases where there is no evidence but they want to keep the details on record - in lots of cases the people will be guilty but nothing can be done - so the letter will help the Council's case in the future.

It is highly unlikely that you will ever be suspected of fly-tipping in the future (no dropping tissues!!) but to make yourself feel better - acknowledge the receipt of the letter but don't accept the warning, point out the reasons (i.e. the car was full of people and couldn't physically fit the waste in).

Once you've done that completely forget about the whole thing.
