NCP car parks parking ticket, passed it to a debt collector!!

Help me please!

6 months ago, parked in a NCP car park, got a parking ticket, but I had paid for parking and the ticket was on display. So the next day, I sent the parking ticket and letter to them. Never heard back so forgot all about it.

Yesterday I recieve a letter from ICC legal company saying I needed to pay £115 in 7 days or they will start legal proceedings against me!!

I called NCP and they said they never received the letter/ticket.

What do I do? I sent the letter recorded delivery, but seems as it was 6 months ago, I don't know where my receipt is! I don't have £115!!

A guy at work, said they can't do that as they have no proof, they don't take pictures like the council etc and it's a civil matter??? Not actually against any laws. Is he just talking shit??

Please help me I'm so scared that balieffs (sp?) are going to turn up at my door.

He is right. Money Saving Expert has a whole forum for these matters. Google it. It's a civil matter. They are enforcing a debt which you are not accepting.

I had one of these years ago. I told them the ticket was wrong and I would not be paying. I asked them if they had any proof and they didn't. They sent me another letter and I ignored it.

They are trying their luck.

IF bailiffs ever turned up, which I doubt they would, you are under NO obligation AT ALL to let them into your home.

You cannot be fined for parking on private property.

You can be charged but not fined.

And that charge has to be in line with the cost to the owner of the land.

So if it is an NCP car park and the parking tarriff says it costs £3 an hour to park and you were there less than an hour they can only charge you £3 + a reasonable admin cost. £115 is not reasonable even if you didn't have a parking ticket.

I think you need to brave it out and not enter into any correspondence with this at all. Its not easy but it has to be done.

As far as I know, it is only parking tickets issues by the council which can be enforced. I stupidly paid one of these NCP ones years ago before I knew that!

For bailiffs to be instructed, they would have to have applied for a CCJ as far as I know and they would only then be instructed if the court had ordered you to pay and your defaulted and as someone says even then you don't have to allow them access anyway.

As I see it they will not be able to prove that you owe them anything because you don't!
