Divorce: if you lied in court, do you have to pay your settlement back?

A man I know is in the shit with his ex for taking 300,000 off her in the divorce court and not buying the flat he told the judge he needed.

He made ex sell her and her adult kids' house in London to pay him off. He has own house in Wales and has lived free with his cousin, rent and board unpaid, near his work in London for 10 years. He moved in with cousin the night his wife told him the marriage was over.

ExW now is complaining that she wants the money back. The Yorks hs was declared, must have been, but the home with cousin certainly wasn't. Does he have to pay it back? Are there any sanctions for being caught lying to the judge?

The fact that his cousin chooses to put him up for free will not affect his rights to a division of the marital assets on divorce, no. Or are you saying he actually owns this house with his cousin?

Corygal · 08/02/2013 09:21

No, cousin is supporting him in her and her husband's house.

So is he or is he or not obliged to pay it back? Has he done anything wrong?

Did the court know he owned a property in Wales?

Corygal · 08/02/2013 09:43

Yes they did - his exwife went there, so not much point fibbing.

Your post discloses no grounds to set aside the order. He didn't lie. Whether he spends the money like he told the court he intended is irrelevant.

Agree with Collaborate. If he had hidden assets from the court it would be another matter but on the information posted it seems all assets were disclosed. How he spends the money is up to him. He can spend the whole lot on wine, women and song if he wants.
