Appeal against an Abatement notice.

I wonder if anyone knows whether if one loses the appeal, costs are incurred? The appeal relates to "the Abatement notice is not justified," in accordance with section 80(3) of the Environmental Protection Act 1990. The Notice has not been broken and the appeal was lodged well within the 21 days. To lodge the appeal, a £200 fee was payable up front.

I have just rung the magistrate's court, and they do not have the answer! They will get back to me.
