My letting agency won't give me a contract.

I have lived in my flat for just over 2 years. I am on a contract that I have to sign to renew every 6 months, It isn't a rolling contract it is for a full 6 months at a time.

My contract was due for renewal in January and the agency didn't send me the paperwork to sign. I chased them up by phone 5 or 6 times and they told me every time that it had been posted/would be posted the next day but I never received anything. Once it got to May I just gave up asking and waited for them to send my new contract to sign in July but again I haven't received anything.

It would seem to me that as the contract expired in January and I didn't sign a new one I am no longer under contract...is this right?

I would like to move at some point and have no idea where I stand in terms of giving notice and getting my deposit back.

You are still under contract but it will have gone to a rolling monthly contract (assuming that you pay rent monthly) on the expiry of your last six months. That is unless the last contract you signed said anything different - do check that carefully.

Again, assuming that you pay rent monthly, you are entitled to end the tenancy on one month's notice once you move onto a rolling contract. That month usually has to start on the first day of a rental period (i.e. you give notice on the day your rent is due and make your usual rental payment, then move out the day before the next rent payment would have been due).

I do pay monthly. My last contract was definitely just a straight forward 6 months then re-sign.

I have always asked them for a rolling contract and they told me no, they don't do them. I even asked in January when my contract didn't appear to sign and again the answer was no Confused
